Terms of use

RV Planet (“we“, “us” or “RV Planet“) provides you with a tool to simplify motorhome/RV trip planning. These Terms of Service (these “Terms“) constitute a legal agreement between RV Planet and yourself (“user or you“). By accessing or using the RV Planet Internet site (“Site“) and any service provided by us, including through any mobile application that we may provide (collectively, the “Services”) you agree that you have read, understood, accept and agree to be bound by these Terms, as well as our Privacy Policy, which is available at privacy policy link and is incorporated herein by reference. If you do not agree to these Terms or the Privacy Policy, do not access or use the Services.

We reserve the right, in our sole discretion, to revise, modify or update these Terms at any time (including in order to remove functionality), and you agree to be bound by any revisions or modifications that we make. Therefore, please review these Terms periodically. Your continued use of the Services after any change or modification of these Terms has been made will constitute your acceptance of the revised Terms.

Services

Your use of the Services is subject to the conditions of these Terms. Currently, we make the Services available free-of-charge to you In order to use the Services, you must be thirteen years of age or older, or have the permission of your parent or guardian. You may not use the Services if you are not allowed to do so by law or regulation. You may not provide access to or use the Services for the benefit of third parties or make commercial use of the Services or content that we provide. You also may not use any or all of the content we provide in order to create a database, whether in print or electronically. You may, however, use the Services in connection with your own activities.

The Services use Google Maps. By using the Services you agree to be bound by Google’s Terms of Use, which you can read at https://developers.google.com/maps/terms.

Accounts

You may register to use RV Planet by providing your name and email or by logging in through Facebook or Google. We may change the method of registration at our discretion. By registering through Facebook you represent and warrant that the Facebook account is yours and you have full rights to provide us with the information in this account. By registering through Google you represent and warrant that the Google account is yours and you have full rights to provide us with the information in this account. We may refuse to allow any user to open an account for any reason at our sole discretion. You agree to supply accurate and complete information to us when creating your account and when using the Services, as well as to update such information promptly after any change. You will be responsible for any inaccuracies in the information you provide to us, or for your failure to keep such information up-to-date.

Do not share your account or login information with any third party, nor let any third party access your account. You are fully and solely responsible for maintaining the confidentiality of the login information for your account and for the security of your computer system, mobile device and all activity on your account, even if such activities were not committed by you. We may terminate your account if you let someone use your account inappropriately or if you or anyone using your account violates these Terms. You agree to immediately notify us of any unauthorized use of your account. We will not be liable for any losses or damage arising from unauthorized use of the Services, and you agree to indemnify and hold us harmless for any improper or illegal use of the Services, and any charges and taxes incurred, unless you have notified us via e-mail at info@rvplan.net.

Termination of Account

We may for any reason, in our sole discretion and without notifying you, terminate your account. Grounds for such termination may include (i) extended periods of inactivity, (ii) violation of the letter or spirit of these Terms, (iii) fraudulent, harassing or abusive behavior or (iv) behavior that is harmful to other users, third parties, the community ethos of our Services or our business interests. In the event that we terminate your account, you may not register for the Services again without our express permission. If you believe that any action has been taken against your account in error, please contact us at info@rvplan.net.

In addition, if we believe, in our sole discretion, that a violation of these Terms or any illegal or inappropriate behavior has occurred, we may take any other corrective action we consider appropriate. We will investigate suspected violations of these Terms or illegal and inappropriate behavior through the Services. Please note that we will fully cooperate with any law enforcement investigation or court order ordering us or directing us to disclose the identity, behavior or activities of anyone believed to have violated these Terms or to have engaged in illegal behavior.

You may request termination of your account at any time and for any reason by sending an email to info@rvplan.net. Any suspension or termination of your account shall not affect your obligations to us under these Terms (including but not limited to ownership, indemnification, any representations and warranties made by you, and limitation of liability), including all those obligations, which by their sense and context are intended to survive the suspension or termination of your account.

Trip Planning

We provide you with an informational tool to assist you in planning your trip. What we do is use your indicated preferences, such as planned dates, type of interests, preferred level of activity and destination preferences, together with our proprietary algorithm, in order to provide you with an itinerary. Please note that in order to provide an itinerary to you, we use information obtained from various sources regarding travel destinations, itineraries, campgrounds, routes, sites, attractions, distances and times, as well as our own experiences travelling in the relevant area and method. Please realize that travel information, by its nature, is highly personal and highly changeable. While we make efforts to ensure that you will receive a travel itinerary and information that fit your needs and tastes and are up-to-date, we cannot and do not represent or warrant that the itinerary or information that we will provide you will accurately reflect your tastes or needs or accurately reflect the state or availability of any destinations, campgrounds, routes, sites or attractions. At any point in time you are free do your own research, contact all relevant service providers and use your common sense before making any travel decisions, payments or reservations. These are your decisions to make.
As we are offering itineraries to a varied vehicle sizes and types, motorhomes, campers, campervan, and more, it is hereby emphasized, it is traveler responsibility to ensure any aspect of his trip, such as (but not limited to):
– Seasonality
– Ferry availability
– Weather forecast
– Vehicle dimension
– Driving restrictions
– Suitable for your rhythm
– Parking arrangements
– Certified instructor if required
– Verify vehicle offenses, navigation limits
– Content fit to travelers age, skills & abilities
– Compliance with local law and local signage
– General duty of care, discretion, responsibility
– Permit from the relevant authorities if required
– Driver driving skills, tiredness, previous experience
– Necessary & emergency equipment, well fitting in sufficient quantity
– Compatibility of the recommendations and guidelines on the site with the situation in reality
– Closed roads, please pay attention carefully, google map might change routes according to the roads current conditions. You should base your route on a navigation software very close to your travel date..

As an added tool to help you plan your trip, we also provide links to the sites of various partners. We may also provide links to other third party sites as well. Please note that we may stop providing or change such links at any time at our sole discretion. Our partners provide various trip related information and services, including reservation services, as well as links to other sites through which such services may be provided. We cannot and do not take responsibility for any information or services provided by our partners, by the sites to which they link, or by other third party sites, as well as for any actions you may take or payments or reservations that you may make through any third party sites, including those of our partners. Any activities on any third party sites are governed by their Terms of Service and Privacy Policies, which we recommend that you review. We cannot and do not take responsibility for whatever happens on the trips you take or for the safety or security of any of the campgrounds, restaurants, attractions, sites or activities recommended on our Services as well as on those sites to which we link or on any third party sites. We do not represent and are not connected to any of the campgrounds, restaurants, attractions, sites or activities that might be recommended on our Services as well as on those sites to which we link or on any third party sites and are not liable for any of their actions. We provide travel recommendations in a dedicated and constructed way for informational purposes; everything that you decide to do in connection with your trips is your sole responsibility.

Submissions

In order to make our Services more dynamic and useful, we may allow you to post comments or reviews or other Submissions to the Services and our forums. “Submissions” means anything material that a user transmits to the Services or to another user while using the Services, including any text, audio or visual material. Please remember that you are responsible for any Submissions you post or transmit. Therefore, you represent and warrant that your Submissions do not infringe the intellectual property, moral, publicity or privacy rights of any third party, and that you have full rights to post or transfer such Submissions. We do not pre-screen Submissions. However, we do reserve the right, at our sole discretion, to remove any Submissions that we believe violate the letter or spirit of these Terms.

Do not worry; we do not claim ownership of your Submissions. However, by sending any Submissions you automatically grant us a non-exclusive, royalty-free, perpetual license of all worldwide rights to use, edit, modify, reproduce, publish, display and distribute Submissions in any manner whatsoever, in or out of context, in all languages, in all media, including for our promotional purposes. In short, if you submit something to us, we may use it.

We have certain rules for using our Services or making Submissions. Therefore, you agree that you will not:

solicit another person’s password or other personal information under false pretenses

impersonate another user or otherwise misrepresent yourself in any manner (including creating multiple accounts or personas) whether to another user, to us, or otherwise

violate the legal rights of others, including defaming, abuse, stalking or threatening users

infringe the intellectual property rights, privacy rights, or moral rights of any third party

post or transmit any Submission that is (or you reasonably believe or should reasonably believe to be) illegal, fraudulent, or unauthorized, or furthers such activity, or that involves (or you reasonably believe or should reasonably believe to involve) any stolen, illegal, counterfeit, fraudulent, pirated, or unauthorized material

violate any applicable law, rule or regulation

publish falsehoods or misrepresentations

post or transmit any Submission that is (or reasonably should be understood to be) libelous, defamatory, obscene, offensive (including material promoting or glorifying hate, violence, or bigotry or otherwise inappropriate to the community ethos of the Services)

post or transmit any virus, worm, Trojan horse, or other harmful or disruptive component

circumvent, disable, or otherwise interfere with security-related features of the Services or features that prevent or restrict use or copying of any content

use any robot, spider, site search or retrieval application, or any other manual or automatic device or process to retrieve, index or data-mine the Services.

You may not, nor may you assist other parties to

copy, modify, or create derivative works of the Services
reverse-engineer, disassemble, or attempt to derive the source code of the software used to provide the Services, including our proprietary algorithm
attempt to disable or circumvent any security mechanism of the Services.

We do not endorse any Submission or any opinion, recommendation, or advice that a Submission may include, and expressly disclaim any and all liability in connection with Submissions. We are not responsible for the accuracy, usefulness, safety or intellectual property rights of or relating to these Submissions. Please realize that you may be exposed to Submissions that are inaccurate, offensive, indecent, or objectionable, and you hereby agree to waive, and do waive, any legal or equitable rights or remedies you have or may have against us with respect to such Submissions.

Intellectual Property

RV Planet and its licensors own the Site and Services, including any material or content made available through the Services, including our proprietary algorithm, and all worldwide intellectual property rights in the foregoing. Except as expressly permitted herein, you may not copy, further develop, reproduce, re-publish, modify, alter download, post, broadcast, transmit or otherwise use any material made available in the Services. You will not remove, alter or conceal any copyright, trademark, service mark or other proprietary rights notices incorporated in the Services. All trademarks are trademarks or registered trademarks of their respective owners. Nothing in these Terms grants you any right to use any trademark, service mark, logo, or trade name of ours or any third party.

No Warranties; Disclaimer

Your use of any aspect of the Services is at your own risk. You must do your own research and make your travel decisions based on that research. We cannot and do not accept any liability in respect of any activities that you may undertake through using the Services.

We make no representations or warranties whatsoever in respect of the Services. Information regarding travel destinations, itineraries, hotels, attractions, sites activities, distances, times and otherwise may be provided by third parties, including Google Maps, as well as by other users of our Services. We cannot accept any liability whatsoever in respect of any content or Submissions which are provided by third parties or by other users of our Services. Any actions you take based on the recommendations regarding travel destinations, itineraries, hotels, attractions, sites, activities, distances, times and otherwise provided by the Services are taken at your sole risk and we will not accept any liability in respect thereof. You should always check any information provided through the Services to ensure its accuracy. To the maximum extent permitted by applicable law, everything available on or through the Services is provided to you “AS-IS” and “As-Available”without warranty of any kind. Without limiting the foregoing, we disclaim any implied or statutory warranties in respect of merchantability, fitness for a particular purpose or non-infringement in respect of the Services. We disclaim any implied or statutory warranties (i) regarding the security, accuracy, reliability, timeliness and performance of the Services; or (ii) that the Services will be error-free or that any errors will be corrected; or (iii) regarding the performance of or accuracy, quality, currency, completeness or usefulness of any information provided by the Services. We do not warrant that any description provided through the Services regarding travel destinations, itineraries, hotels, attractions, sites, activities, distances and times or otherwise is accurate, complete, reliable, current, safe or error-free. We are not responsible for the use of any personal information that you disclose on the Services or through any Submissions. We disclaim all liability, regardless of the form of action, for the acts or omissions of other users (including unauthorized users).

No advice or information, whether oral or written, obtained by you from us, shall create any warranty not expressly stated in these Terms. If you choose to rely on such information, you do so solely at your own risk. Some states or jurisdictions do not allow the exclusion of certain warranties. Accordingly, some of the above exclusions may not apply to you.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall we be liable to you or any third party for any damages, including but not limited to general, incidental, consequential, indirect, direct, special or punitive damages, arising out of or relating to the Site, Services, Submissions or content. In any case, our entire liability under any provision of these Terms shall not exceed amounts paid by you directly to us for the use of the Services hereunder. As such, if you have not made any payments to us in order to use the Services, we shall not have any liability to you whatsoever.

In addition to the foregoing, we assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission or communications line failure. We are not responsible for any problems or technical malfunction of any telephone or cellular phone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email due to technical problems or traffic congestion on the Internet or on the Site, including any injury or damage to users or to any person’s mobile device or computer related to or resulting from participation or use of the Services. Under no circumstances shall we be responsible for any loss or damage, including personal injury or death, resulting from use of the services, whether online or offline, or in connection with travelling while using the Services.

Indemnification

You agree to indemnify, defend, and hold us harmless (including our employees, directors, officers, subcontractors and agents) against any and all claims, damages, losses, liabilities, costs or expenses (including reasonable attorneys’ fees and court costs) that arise directly or indirectly from: (a) the breach of these Terms by you or anyone using your computer, mobile device, password, Facebook account, Google aacount or login information; (b) any claim, loss or damage experienced from your use or attempted use of (or inability to use) the Services; (c) your violation of any law or regulation; (d) your infringement of any right of any third party, including without limitation the infringement of any third party intellectual property right or moral right; or (e) any other matter for which you are responsible under these Terms or under law. You agree that your use of the Services shall be in compliance with all applicable laws, regulations and guidelines.

Infringement

Under the Digital Millennium Copyright Act of 1998 (the “DMCA”), it is our policy to respond to copyright owners who believe material appearing on the Services infringes their rights under US copyright law. We accept no responsibility or liability for any Submissions, or any material provided or posted by a user. If you believe that something appearing on the Services infringes your copyright, you may send us a notice requesting that it be removed, or access to it blocked. If you believe that such a notice has been wrongly filed against you, the DMCA lets you send us a counter-notice. All notices and counter-notices must meet the DMCA’s requirements. We suggest that you consult your legal advisor before filing a notice or counter-notice. Be aware that there can be substantial penalties for false claims. It is our policy to terminate the accounts of repeat infringers in appropriate circumstances. Send notices and counter-notices to info@rvplan.net.

Trip Planning and Booking

This section sets forth terms and conditions that are applicable to the purchase of any trip planning services or campground booking services from RV Planet, including any combination of the following services: RV rentals, campgrounds, tourist attractions, sightseeing tours, as well as activities chronologically adjacent to your RV/motorhome trip such as flights, hotels, taxis, limousines, ferries, or other travel (any of the foregoing or combination of the foregoing, a “Trip Plan and/or Campground Booking and/or Chronologically Adjacent Activities”).

Support and Service Guarantee. Your satisfaction is important to RV Planet. RV Planet makes significant efforts to ensure you have a pleasing travel experience. As such, RV Planet offers support services in the event you are not satisfied with the services provided by RV Planet. Through the support services, RV Planet shall make commercially reasonable efforts to assist users in facilitating the arrangements purchased in a tripe. Notwithstanding the foregoing, RV Planet is not affiliated with and cannot control for any vendor or service provider, including without limitation any provider travel or accommodation services. As such, RV Planet does not accept any liability for the actions or omissions of such third party service providers. If RV Planet offers certain money-back guarantees, the amount of such guarantees shall be limited to a specified amount designated by RV Planet and, if RV Planet does not expressly designate a specified amount then the amount of such guarantees shall be limited to USD 100. All complaints regarding services provided by RV Planet must be sent to info@rvplan.net. RV Planet does not provide any support or guarantees in respect of Services that were not paid for in full.
Prices. Price quotations for service levels and memberships displayed on the Site are not final and are subject to availability and change without notice until reserved and paid in full. RV Planet reserves the right to correct any error in any displayed price prior to the processing of your payment. In the event of a pricing error, you will be informed by email or phone and will be given the option to approve the correct price or cancel your membership and/or booking without penalty. The price of any membership or booking does not include ground transportation unless otherwise expressly specified in your itinerary. The price of any trip plan does not, except as may be expressly stated otherwise in a written statement provided by RV Planet, include incidental or accompanying expenses such as laundry, parking, food and beverages of any kind, excess charges related to persons or baggage, insurance or baggage insurance, or tips and gratuities. Prices for campgrounds are subject to occupancy, unless expressly stated otherwise. Trip Plans and Campground Bookings are not transferable.
Taxes. Unless expressly stated otherwise, prices for memberships and Services generally include applicable taxes. Such taxes may include applicable sales and use, occupancy tax, excise tax, value added taxes and similar taxes and government charges. Notwithstanding the foregoing, RV Planet cannot guarantee the price displayed includes all applicable taxes. RV Planet offers Campground Bookings in numerous locations worldwide and, as such, it is impossible for RV Planet to provide up-to-date information regarding all applicable taxes and it may not be possible or legal for RV Planet to collect certain local taxes. As such, notwithstanding any price displayed through RV Planet, you are responsible for payment of any and all local taxes that RV Planet does not directly collect. RV Planet shall not be responsible for any taxes applicable to any Trip Plan and/or Campground Booking, or any transactions or services provides as part of a Trip Plan and/or Campground Booking. RV Planet is not the vendor collecting and remitting taxes to the applicable tax authorities. Tax payments are transferred to the applicable vendor or service provider which then remits such taxes to the applicable authorities. RV Planet is not a co-vendor with any service provider. Tax rates may vary significantly by location and the date of the transaction.
Confirmation and Payment Terms. You are responsible for confirming all components of your itinerary prior to making your confirmation. Upon receiving your confirmation, RV Planet shall request the reservation of all components in your itinerary, which is usually immediate, but may take between two to five business days. Select destinations and services may require additional time, especially if purchased during specific times of the year. campgrounds must be booked immediately once created online in order to hold the price and availability. Prices for saved but unconfirmed bookings not paid for in full may need to be recalculated at the time of reservation or confirmation. If RV Planet cannot reserve a component of your itinerary, we will contact you so you can approve an alternative, which may lower or increase the cost of the booking, and according to the level of your membership, may incur a processing fee. You will be notified about the refund policy of vendors booked via RV Planet. You should check the refund policy of all other vendors and service providers, as set forth below in Section 9. In connection with payment in respect of your Trip Plan and/or Campground Bookings through the Services, you will be asked to provide customary billing information such as name, billing address and credit card information either to RV Planet or its third-party payment processor(s). You hereby agree to pay the costs of the membership and/or booking fees as detailed on the Site when confirming a reservation in accordance with these Terms by one of the methods described on the Site. Your hereby acknowledge that RV Planet may not accept all types of credit cards, at its sole discretion. You hereby authorize the collection of the costs by charging the credit card provided, either directly by RV Planet or indirectly, via a third-party online payment processor, or by one of the payment methods described on the Site. If you are directed to a third-party payment processor(s), you may be subject to terms and conditions governing use of that third party’s service and that third party’s personal information collection practices. Please review such terms and conditions and privacy policy before using the Services. If you opt for payment by credit card, your credit card will be charged for the indicated amount only when all air, hotel and services are reserved and confirmed by RV Planet and your credit card statement will reflect a charge from the applicable service provider and/or the merchant of record, which may be different than the service provider. Regardless of the identity of the merchant of record and subject to the terms hereof, you will not be charged more than the total price of the applicable membership and/or processed bookings and changes to bookings. No prices, availability, or dates of travel are finally reserved and confirmed until the required payment for the entire combination of membership fees and booking fees is processed and received in full.
Vouchers. After processing of your full payment, RV Planet will provide a final confirmation email with applicable vouchers. Such vouchers constitute proof of payment for the applicable vendors and service providers. All vouchers must be provided to the applicable vendor and service provider in order to receive the applicable product or services from the applicable vendor or service provider. Please ensure that you provide the correct email address for receipt of the vouchers. RV Planet shall have no liability or responsibility for lost or stolen vouchers if you provide incorrect email addresses or contact information. Vouchers will show RV Planet as the official issuer of services.
Travel Documentation and Passports. Passengers are responsible for ensuring they posses and present valid and appropriate travel documents. A valid passport with at least 6 months validity after the date of travel is generally required. A driver’s license that is valid throughout the entire period during which you are travelling in a motor vehicle is generally required for you and/or all other persons travelling with you that may drive the motor vehicles with which you are travelling the planned trip.
You are responsible for checking with the appropriate authorities regarding whether any visas or vaccinations are required. RV Planet shall not provide any refunds for passengers who cannot embark or complete any portion of their itinerary due to incomplete travel documentation. In particular, passengers must ensure that they possess and present appropriate documentation for minors, including any minors travelling alone or with only one parent. You are responsible for ensuring that names on reservations match the information included in your travel documents. Names changes are not allowed after the processing of reservations. Third party providers do not generally allow name changes on their tickets.
Tickets and Documentation. Electronic confirmation and applicable documentation will be sent to the e-mail address you provided on the booking pages. If electronic vouchers cannot be provided for you, RV Planet must issue paper vouchers and will ship the documents via Fedex or another carrier (standard fees apply). We will add the appropriate shipping charges to the cost of the booking. We may also add the shipping charges to the cost of membership at our sole discretion. Additional fees apply for Saturday, Sunday, early morning or late night arrivals or other situations requiring unusual or rush delivery. Delivery addresses for FedEx or other couriers must be street addresses. No P.O. boxes will be accepted. Delivery by FedEx or another courier is subject to the general terms of service of the applicable courier. Please ensure that you provide the correct address information for receipt of the documents. RV Planet shall have no liability or responsibility for lost or stolen documents if you provide incorrect address or contact information.
Changes and Cancellation Fees. Vendors and service providers may charge fees for changes and cancellations. Certain bookings may be non-refundable or non-cancellable or may not permit changes. You are responsible for checking the policies of all vendors and service providers, including without limitation any providers of transportation and accommodation. RV Planet cannot waive and will not be responsible for any fees for changes or cancellations which are charged by the applicable vendors or service providers. You shall have sole responsibility for all fees in respect of changes and cancellations. RV Planet has the right to cancel a booking in the event of non-payment or payment dispute. RV Planet has the right to retain booking fees collected for a booking and to demand additional fees for cancellations on your behalf related to non-payment or payment disputes. If you choose to cancel any portion of your membership and/or bookings through RV Planet, we must receive such cancellation notice in writing. Verbal cancellations are not accepted. Please send your cancellation request to info@rvplan.net.
Currency. All prices are expressed in the local currency of the third party service provider unless specifically indicated otherwise. You may change the displayed currency to see the prices in other currencies, but rates presented in currencies other than the currency presented by the campground or service provider are guidelines only and may vary according to changes in currency exchange rates. Check the date on the applicable “currency converter” to see the date that the applicable exchange rate was last updated. RV Planet does not guarantee that any currency exchange rates will be up-to-date. Please consult professional advisors to understand the accuracy of any currency exchange rates. Actual payment will be charged in the currency requested by the hotel or other service provider. You should not use currency exchange rates provided by RV Planet or the Site for any purpose other than roughly estimating payments to be made in respect of a Vacation Package.
Bank and Credit Card Fees. Some credit card companies and banks may impose foreign transaction fee for international transactions and/or a currency exchange fee. The foreign transaction fee and/or currency exchange fee is determined solely by your bank and/or credit card company. If you have any questions about these fees or the exchange rate applied by your bank or credit card company, please contact your bank and/or credit card Company. RV Planet does not and will not have any liability or responsibility for any such foreign transaction fees and/or currency exchange fees and/or for any exchange rate offered to you by your bank and/or credit card company when making payments in respect of a membership or booking fee.
Breakdown of price of membership and/or booking components: RV Planet is able to offer planning and booking components that are bundled together. For that reason, we are not always directly able to itemize the price for you of each component that makes up a trip, including but not limited to price per night in any campground or other accommodation. In the event you choose to change your plans and stay more or less nights in a campground or other accommodation, the price per night in a campground or other accommodation may vary per night and breakdown of the total price in respect of a campground or other accommodation may not lead to an equal price per night. In the event you cancel one or more nights in a campground or other accommodation and request a refund, such refund may be provided, if applicable, in accordance with Section 15 below, and the amount of refund shall be the in accordance with the price applicable in respect of the specific night(s) cancelled. The act of cancellation does not automatically incur a cancellation of previously paid booking fees, and does not exempt you from being charged with additional processing fees to execute and manage the cancellation.
Campgrounds and Accommodations. All pricing and descriptions of campgrounds and other accommodations reflect the most up-to date information provided by the applicable property. RV Planet does not have any liability or responsibility for such descriptions, the failure of any campground or other accommodation to satisfy those descriptions, or the actual conditions of any campgrounds or other accommodations. RV Planet will not provide refunds for any of the foregoing. RV Planet does not have any liability or responsibility for any amenities that any campground or accommodation stated will be provided, or will provided at no charge, and which are not actually provided or which are provided for a charge. You must raise any complaints directly with the management of the applicable campground or other accommodations, and not with RV Planet. RV Planet shall have no liability or responsibility for any such complaints. You can sort any list of accommodations provided by RV Planet by customer ranking, price, name or hotel class. Our default is to display a list of hotel sorted by our reasonable interpretation of what hotels offer you the best value for the purchase price. Nonetheless, we cannot accept responsibility for the order of such list and do not warrant that any hotel will offer any specific value, experience or price. You must examine all accommodation options and select the accommodations that are the best for your tastes, requirements and budget. Lower priced options will generally be of lower quality. The size and location of parking spots and camping spaces, is not guaranteed and is subject to availability at the time of check-in at the applicable campground. Generally, reservations confirmed with fully divulged information about the number of adults and children travelling with you should match those parameters. You must confirm the number and size of parking spots and spaces and such details will be subject to the policies of the individual campground. Special requests (such as but not limited to early check-in, late check-out, non smoking areas, other specific requests) are subject to availability at the time of check-in and any other applicable policies of the specific campground. If any such requests are important to you, then you must check such policies prior to confirming your booking. You shall have sole responsibility for any charges or fees in respect of changes to or cancellations of any reservations or bookings, and RV Planet shall have no liability in respect thereof. RV Planet has no responsibility for overbooked spaces or the policies of specific campgrounds or other accommodations with respect to overbooking. RV Planet does not accept any “points”, “membership points” or other reward programs to pay for accommodations, and accommodations booked through RV Planet will generally not allow for the accumulation of points. Individual campgrounds may be required to charge “accommodation provider”, “city” or “departure” taxes as required by law, and these taxes may not be reflected in the price of RV Planet’s membership and or booking fees.
Complaints and Refunds. All complaints regarding services provided by RV Planet must be sent to info@rvplan.net. Complaints regarding any vendor or service provider must be directed to the management of the applicable vendor or service provider, including but not limited to any specific campground or other accommodation, RV/Motorhome rental company, airline, sightseeing tour operator, tourist attraction operator and/or other provider of any services provided as part of the trip and not to RV Planet. RV Planet shall have no liability or responsibility for any such complaints, and shall have no liability or responsibility for passing on such complaints to the applicable vendor or service provider. Notwithstanding, in the event a complaint is not handled by the relevant vendor or service provider, you may contact RV Planet’s email address. In order for RV Planet to attempt assisting in finding a solution for and/or passing on your complaint to the relevant vendor and/or service provider, you must contact RV Planet during your stay. Prior to cancelling any trip, booking or part thereof, you must check all applicable cancellation and refund policies of all vendors and service providers. RV Planet shall make commercially reasonable efforts to provide refunds in accordance with such policies. If you cancel any booking in accordance with these Terms, RV Planet shall refund amounts paid, provided that such amounts are also refunded by the applicable vendor or service provider. RV Planet shall not be liable for amounts not refunded by the applicable vendor or service provider, and shall have no obligation to provide a refund in respect thereof. RV Planet shall not be liable for any fees charged by your bank and/or credit card company used to make the payments in respect of a membership or booking fee, in case of cancellation of such. If applicable law provides you with any additional rights that were not waived under these Terms, you must first pursue such rights against the applicable vendor or service provider.

Miscellaneous

These Terms shall be governed by the law of the State of Israel exclusive of its choice of law rules. Your conduct may also be subject to other local, state, and national laws. Any action to be brought in connection with these Terms, the Site and/or the Services shall be brought exclusively in the court located in Tel-Aviv/Jaffa, and you irrevocably consent to its jurisdiction. Any cause of action against us must be brought within one (1) year of the date such cause of action arose. In the event that any provision of these Terms is held to be unenforceable, such provision shall be replaced with an enforceable provision which most closely achieves the effect of the original provision as permitted by applicable law, and the remaining terms of these Terms shall remain in full force and effect. Nothing in these Terms creates any agency, employment, joint venture, or partnership relationship between you and us or enables you to act on our behalf. Except as may be expressly stated in these Terms, these Terms constitute the entire agreement between us and you pertaining to the subject matter hereof, and supersedes any other agreements, understandings or warranties. Nothing contained in these Terms shall be construed to limit the actions or remedies available to us with respect to any prohibited activity or conduct. Non-enforcement of any term of these Terms does not constitute consent or waiver, and we reserve the right to enforce such term at our sole discretion. No waiver of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default. We may assign our rights under these terms to any third party. You may not assign your rights or obligations hereunder except as we expressly permit in writing.
